DCMS review of powers of entry - final report

The final report from the DCMS following a review into powers of entry has been issued today and can be found here.

Numerous powers of entry under different Acts were considered including those related to the need to:

  • Enforce gambling regulations to keep crime out of gambling, and protect vulnerable people from being harmed or exploited by gambling; and
  • Prevent the supply of age-inappropriate content to children.

The report concludes that for the Children and Young Persons Act 1933 (specifically s.12 Failing to provide for the safety of children at entertainments) this is to be retained with a wider review to be taken forward once the current proposed deregulation of entertainment under the Licensing Act 2003 is enacted (which should be 6th April 2015 - see our article 'Legislative Reform (Entertainment Licensing) Order 2014 - coming into force 6th April 2015)'.

Further, numerous powers of entry under the Gambling Act 2005 (ss.306(1), 306(2), 307 to 314 inclusive, 315(1), 315(2), 318(2) and 319(2)) are to remain unchanged so as not to “undermine the efficacy of enforcement action”.
